1.Our approach
Cuanto Labs LLC respects the intellectual property rights of others and expects users of qraffic to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. 512 (the "DMCA"), and to valid notices under similar laws in other countries. This policy explains how to send a notice, how to respond to one, and what we do with them.
2.Reporting infringement
If you believe that material on the Service infringes a copyright you own or are authorized to enforce, send our designated agent a written notice that includes:
- your physical or electronic signature;
- identification of the copyrighted work you claim is infringed, or a representative list if several works are covered by one notice;
- identification of the material you claim is infringing, with enough information for us to locate it, such as the specific URL;
- your name, postal address, telephone number and email address;
- a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner of the copyright or authorized to act on the owner's behalf.
Notices that do not include these elements may not be valid under the DMCA. Before sending one, consider whether the use could be a fair use.
3.Our designated agent
Our designated agent for notices of claimed infringement is:
Copyright Agent, Cuanto Labs LLC
Cuanto Labs LLC
1314 E Las Olas Blvd, Unit #2570, Fort Lauderdale, FL 33301, USA
Email: legal@qraffic.com
This address is only for copyright notices. Other messages sent to it will not receive a response; please contact support@qraffic.com instead.
4.What happens after a notice
When we receive a valid notice, we act expeditiously to remove or disable access to the material, notify the user who posted it, and give them a copy of the notice, which may include your name and contact details. We may also forward the notice to the Lumen database or a similar project that tracks takedown requests, with your personal contact details removed.
5.Counter-notices
If you believe material you posted was removed because of a mistake or misidentification, you may send our designated agent a counter-notice that includes:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification;
- your name, address and telephone number; and
- a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located or, if your address is outside the United States, any judicial district in which Cuanto Labs LLC may be found, and that you will accept service of process from the person who sent the original notice or their agent.
When we receive a valid counter-notice, we send a copy to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to restrain the activity, we will restore the material within 10 to 14 business days after receiving the counter-notice.
6.Repeat infringers
In appropriate circumstances, we disable or terminate the accounts of users who are repeat infringers. We generally treat an account as belonging to a repeat infringer when it has been the subject of more than two valid notices that were not successfully countered, and may act sooner for serious or willful infringement.
7.False notices
Under 17 U.S.C. 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. If you are unsure whether material infringes your rights, consult a lawyer first.
8.Changes to this policy
We may update this policy from time to time, for example if our designated agent changes. The latest version is always on this page, with its "Last updated" date.
